When determining that an employee should return to work, the employer must give notice once the employer receives medical clearance that the employee is fit to return to work. In giving notice, the employer must provide the employee with notice that a job is available that fits their post injury ability to perform work, even though partially disabled. This requirement has led to many claims that litigate the issues of: (1) whether a job is actually available and (2) whether the offered job accommodates the partial disability.
To determine your rights upon returning to work after partial disability, please consult a PA workers Compensation lawyer.
